Board of Selectmen Minutes -- 12/04/2006
Present:  Gino Funicella Chairman, Gary Allen Beatrice Davis Selectmen

Visitors: Jackson Police Chief Karl Meyers, Terry Miller Rick Alimi Rod Wilson New Hampshire Forest Service, Kurt Kramp Jackson Zoning Board of Adjustment, see attached attendance sheet

  1. The minutes of November 27 , 2006 were reviewed and approved as written.

  2. The Summary of Payments was reviewed and checks were signed in the amount of $335,802.66.                        
   3. The Financial Resume indicated an amount of $522,864.63 in the general fund after tonight’s vouchers.

  4. Deposits in the amount of $4.483.96 were transferred to the treasurer tonight.

  5. Jackson Police Chief Karl Meyers attended the meeting to advise the selectmen of the following police department activities; assisted New Hampshire State Police with a DWI on Rt. 16, 6 Christmas wreaths stolen from local business, investigated disabled armored car on Thorn Hill Road, assisted Jackson Welfare Officer advising her about court papers, complaint of a hunter on private property, accident on Jackson Highlands Road, assisted citizen with a ride at night, report of gun shots on Sugar Hill Lane, car accident on Rt. 16, and a welfare check on Project Good Morning. Chief Meyers requested to use the part-time officer budget for over-time pay for Officer Cowland and Chief Meyers. The overtime budget was expended in September and they have been working without pay. The selectmen agreed that Chief Meyers and Officer Cowland should be remunerated for any time that is worked and should use the part time officer portion of the of the budget.

  6. There was discussion regarding the list of driveways where water is running off onto town roads and has the potential of causing an ice problem. Gary Allen stated that the list should be reviewed by the Road Agent. The selectmen agreed that Arthur should refine the list and submit it to the selectmen.

  7. The selectmen will review the E-911 maps and will make a decision on Friday, December 8, 2006 regarding signing the acceptance letter.

  8. The selectmen approved the purchase of blinds for the windows of the Jackson Police Department if there are funds left in the Maintenance of Town Property Buildings budget.

  9. The selectmen reviewed the request from Charles Perfetuo. Mr. Perfetuo is scheduled to close on a property on Juniper Way and is requesting that the building permit expiration date be extended. Since the building permit application is several years old, the selectmen agreed that the building inspector should review the permit and make a site visit to the property for an inspection. If the extension is approved a $75 fee will be required.

 10.  The selectmen reviewed and discussed the draft of the revised building permit application. The selectmen had questions about additional inspections. They feel the building permit application should be filled out in pen/ink. Before accepting this draft they will clarify the inspection schedule with the building inspectors.

 11. Gino Funicella stated after our request the town received a fax from Attorney Upton regarding the November 20, 2006 decision from the State of New Hampshire Supreme Court regarding the helicopter landing. The Town of Jackson lost the case. The Jackson Zoning Board of Adjustment’s ruling was held up in court. Gino Funicella had concerns over the length of time it took for the town to be notified of the decision. Gino would like a meeting with Mr. Upton regarding the outcome of this case and lack of notification to the town. Kurt Kramp advised the selectmen the case was held in a closed session by 3 Justices. The zoning board was notified the day after the decision. The selectmen noted the town was not notified for almost 2 weeks.

 12. Gino Funicella stated he requested that Julie Maiorano contact Local Government Center regarding the tactical police training that was prearranged in Bartlett. The LGC stated the police department booking the training must notify any local police departments. Jackson Police Department was not notified.  

  13. The selectmen received a letter from a local attorney for services. They reviewed the letter and will take it under advisement.

 14. Gino Funicella stated that he was advised by Julie that she spoke with Anne Peterson regarding the specifications of Cyrus Road. Julie advised Anne Peterson to contact Gary Speirs to discuss the specifications of Partridge Lane to determine what is required for Cyrus Road.  

  15. Gino Funicella mentioned the 2006 tax rate for Jackson is $8.70 per thousand which is a reduction of 30 cents from 2005. The final tax bills were mailed on November 27, 2006.

 16. Kurt Kramp requested information regarding placing a fence in the right of way of the town. He stated a fence on Thorn Hill Road appears to be in the town’s right of way. The selectmen will request information from the Jackson Planning Board about fences in the right of way.

 17. Terry Miller, Rick Alimi, and Rod Wilson attended the meeting to discuss the Than Project. This is a forest resource management project in the national forest which includes forest management, transportation system, wildlife and aquatic habitat improvements and recreation management. The project also includes a timber cut where logging trucks will be exiting Prospect Farm onto Carter Notch Road.  Gino Funicella mentioned that Terry attended the meeting tonight to update the selectmen. It was not intended as a Public Hearing. Terry Miller discussed the aspects of the project.  This is the second comment period for the Than Project.  There was a large meeting in February, 2006 which was posted as a Public Hearing. At the time legal announcement was made in the Conway Daily Sun and Manchester Union Leader. After the first comment period, the project was fine tuned. An alternative was selected and a decision was signed in May. There was an appeal filed by 5 parties. The project was returned based on one of the appeals. A court decision required the forest service to reinstitute a Road Less Rule and to make sure the project area was not in the 2001 Road Less Rule. Since there were changes to the documentation, the forest service was bound to send out the plan for comment. It was published on November 17, 2006 and there is a 30 day comment period where written comments are accepted. Written comments may be submitted to comments-easter-white-mountain-saco@fs.fed.us with an identifiable name by December 18, 2006.  Alternative 4 was selected the first time but at this point Terry does not know if that alternative would be selected again.  Gino stated that in alternative 4, there is a great deal of fall harvest and wondered if the harvest could take place after fall foliage. Terry stated that some adjustments can be made.  There were many questions and concerns about the logging trucks on Carter Notch Road. Some issues that were mentioned were traffic, safety, dust, damage to the road and noise.  Rick Wilson stated there would be approximately 1,000 truck loads during this cut but not all will go out on Carter Notch Road. Approximately 800 truck loads would be driven down Carter Notch Road over 4 years which is approximately 200 trucks a year. The other 200 truck loads would be taken on an alternative route. There was discussion regarding reducing the speed of that road. Terry mentioned he is agreeable to contacting Greg Placy, New Hampshire Department of Transportation to discuss this issue.  Gino mentioned a bond will be required from the logger for the road which is written into the contract. Another issue raised was that Marsh Brook is used for a water system. There were questions about the Popple Mountain and Prospect Farm project overlapping. Terry stated there would be some overlapping.  Thom Perkins, Jackson Ski Touring suggested the cut be split between east and west side of Prospect Farm to keep one area open for skiing during the season. An east/west split would not affect the skiing on both sides. There were concerns regarding the impact on the local businesses if Prospect Farm did not have any cross country skiing available. Terry stated some limits can be put in place but it makes it more difficult for a person to bid on the job. Terry Miller requested that since we are in a comment period, the questions should be put in writing.  Terry mentioned he would like to consider dialogue with New Hampshire Department of Transportation regarding speed limit signs on Carter Notch Road, distributing the sales over time to lessen the effects on skiing at Prospect Farm and businesses, and also consider the east and west split for the cut.

 18. The meeting started at 5:30 p.m. and ended at 8:35 p.m.
