Board of Selectmen Minutes -- 12/05/2004
Present: Selectmen: Diane McClave Chairman, Richard Bennett, Gino Funicella Selectmen

Visitors:  Jackson Police Chief Karl Meyers, Gary Spiers, Mike Epelman, Tracey Mosston

  1. The minutes of December 13, 2004 were reviewed and approved as written.

  2. The Summary of Payments was reviewed and checks were signed in the amount of $23,548.42.

  3.  The Financial Resume indicated an amount of $194,941.62 in the general fund after tonight’s vouchers.

  4. Deposits in the amount of $37,291.14 were transferred to the treasurer tonight.

  5. Tracy Mosston attended the meeting to discuss worker’s compensation. Tracy spoke with a representative from Primex regarding canceling the coverage currently contracted by the town.  For the year 2005 the town will receive coverage from the Local Government Center. The 45 day cancellation requirement will bring the town to the end of January. The amount owed Primex is January premium $1,760, $841 which is a 10% penalty charge for canceling, and the town would not receive the return check due the town for premiums for 2004. The selectmen will send a letter to Primex requesting the fees that were overpaid be applied to the January 2005 premium.

  6. Gary Spiers and Mike Epelman, homeowners on Eaglewood Road, attended the meeting to discuss development of Eaglewood Road and lifting the moratorium on building on the road. There was discussion regarding proposed logging on the road. Richard Bennett stated intent to cut has not been received by the town and the town would require a bond from the logger. If there was any deterioration of the road caused by the logging trucks, they would be required to bring the road back to its current state.  Dick also explained the proposal from Sean Doucette was to upgrade the road from the entrance to the left hand fork and not the right hand fork in order for him to build one house. Mr. Spiers and Mr. Epelman stated the homeowners on Eaglewood Road used the Jackson Town engineer in 2000 and he came up with a set of recommendations of how the road should be completed so the moratorium could be lifted. They also stated the homeowners on Eaglewood Road have incurred expenses to maintain this road. Mr. Spiers questioned whether Sean Doucette would share in the maintenance of this road. After much discussion regarding the road and building on the road Gino Funicella and Richard Bennett stated no decisions will be made unless all parties are available. Diane McClave suggested that a meeting between Sean Doucette, Anne Peterson and the property owners on Eaglewood Road be scheduled to discuss this road with all interested parties.

  7. Chief Karl Meyers attended the meeting to discuss police department issues. Richard Bennett questioned if fire arms purchased for the new officer belonged to the town. Chief Meyers explained that all fire arm purchases belong to the town and are assigned to the officer. There was discussion regarding a letter received by the selectmen from the Wildcat Inn and Tavern. This letter states the owners feel they have been subject to police harassment regarding Hoot Night at Wildcat Inn. Chief Meyers stated there were complaints regarding noise and he has tried to maintain a presence without being in front of the Wildcat Inn. Chief Meyers stated this is just part of his patrol duties. Gino Funicella stated the town has a responsibility to answer to complaints regarding noise and that the selectmen requested this of the police department. The selectmen agreed they would like Mr. & Mrs. Sweeney to attend a meeting with Chief Meyers to address the concerns regarding their establishment. Karl advised the selectmen that Officer Sean Cowland passed the state physical agility test. He will be taking the required law classes in January. Karl informed the selectmen an individual left the Wildcat Gas Station without paying and he was able to locate the car in Glen and bring him back to pay for the gas. The Wildcat attendant felt it was an honest mistake and no charges were pressed. Richard Bennett requested information on the old town vehicle that was sold with Town of Jackson still on it. Karl spoke with the gentlemen who stated it was sold as is and he is too busy to remove it at this point, but the town could remove it. Dick stated he will speak to Arthur Fernald, Road Agent, regarding removing the lettering off the car. Chief Meyers will accompany Arthur.

  8.  There was discussion regarding the appreciation Christmas Party for town employees at the Red Fox. Gino Funicella motioned the dinners for the party be paid by the town. It was seconded. Motion carried.

  9. The selectmen received a response from town counsel regarding the will for Prospect Farm. After reviewing the will it is his opinion a conservation easement is not required to protect Prospect Farm from being sold. It is clear in the will this land will always remain an open recreation space.

 10. A letter was received from Coughlin, Rainboth, Murphy & Lown attorneys representing Steven and Anne Frost regarding a garage built within the 25 foot setback. A letter will be sent to the Wildcat Inn and Tavern requesting they file for a variance with the Jackson Zoning Board of Adjustment.

 11. Diane McClave stated the minutes should reflect for 2005 the state wide enhanced education tax payment for Jackson is $905,121.

 12. The meeting started at 4:00 p.m. and ended at 6:10 p.m.
