Board of Selectmen Minutes -- 01/09/2005
Present: Selectmen: Richard Bennett Chairman, Gino Funicella, & Gary Allen, Selectmen


Visitors:   Scott Hayes, Jackson Police Chief Karl Meyers, Brian Schutte Department of Transportation, Ed Dubie , Lynn Stevens Sam Harding Library Trustees, Tracy Mosston

   * The minutes of December 19, 2005 were reviewed and approved as written.

    * The Summary of Payments was reviewed and checks were signed in the amount of $10,994.79

   * The Financial Resume indicated an amount of $858,465.98 in the general fund after tonight’s vouchers.

   * Deposits in the amount of $1,827.54 were transferred to the treasurer tonight

   * Scott Hayes attended the meeting to discuss a project the Jackson Water Precinct is considering.  There are funds left over from a previous project and would like to extend the water main in the water district. Scott presented design drawings, construction and bid specifications to the selectmen from the engineer. This project is a 500 foot water main extension from the intersection of Precinct Road 50 feet beyond where the water main ends on Green Hill Road.  There will be a fire hydrant and valve cap installed for the future. They are considering continuing to the highway and loop it back to the Red Fox Pub as a back up to feed from another direction. The precinct meeting is Wednesday and final approval will be decided by the Jackson Water Precinct Commissioners.  Scott stated Arthur Fernald, Jackson Road Agent, agrees with the plan. Scott stated the pavement cuts for this water main will damage the road. Rural Developments regulations will pay for the repair. The engineers have indicated that since this is a small project it will be cost effective to do a cut and patch and a one inch overlay over the entire road. Rural Developments should agree to this. Scott is requesting permission for a waiver from the town on the road bans. Ed Dubie stated this is a good road and there would not be much impact when the road bans are on.  The whole project is covered under the water precinct’s budget and is acceptable to Rural Development. There was discussion of the future of the water precinct and hydraulic flow. Scott stated this project is fully bonded with a one year warranty on the road. Richard Bennett stated a discussion at the next selectmen’s meeting with Arthur Fernald and Scott about proceeding with this project before the road bans are lifted is advisable.   

    * Jackson Police Chief Karl Meyers attended the meeting to discuss police department issues and activities. The town was busy during the holiday vacation. Some recent activity for the police department were as follows: accident in notch, accident in driveway on Tin Mine Road, accident on 16 where driver fell asleep, driver  lost control of their car by Old Jackson Road, 3 assists to ambulance rescue crew, investigated suspicious vehicle Beech Hill Road and near Rocky Branch Trail Head, disposed of dead coyote, responded to 5 house alarms, several elderly checks, two people reported they lost their license plates, neighbor dispute concerning a loose dog, investigated a possible break in of a house, Jackson Ski Touring Foundation reported damage to one of their trails, assisted Bartlett Police Department with an arrest, the police department is handling a complaint from Black Mountain, assisted tractor trailer that ran out of gas, wallet found on Black Mountain Road was turned in, credit cards found on a ski trail was turned in, complaint of JST bus speeding on Carter Notch Road, complaint of harassing phone calls, several 911 hang ups, barking dog complaint, lost cell phone found and returned to owner, and investigated a complaint where a door bell was rung on Mountain View Road in the middle of the night.  New Year’s Eve was quiet, but did have one marijuana arrest. Richard Bennett had questions about day time parking on the road.  Karl stated wherever there are no parking signs the regulations are enforced. If the road crew has difficulty plowing in areas where people are allowed to park, they contact the police department and we request that people move the cars for plowing purposes. Karl will check the Dundee Road for signage.  Gary stated there are some cars that are parking on Main Street in the no parking areas. Karl stated the police department does ticket these areas where no parking signs are visible. Karl met with New Hampshire Department of Transportation and more signs were added in the village.  

    * Brian Schutte, New Hampshire Department of Transportation, attended the meeting to discuss plans that have been drawn by the state for moving a portion of Black Mountain Road.  He submitted plans for the intersection of 16 A and 16B. They did survey and engineering plans. A base plan for 16A heading toward Route16 to the covered bridge was submitted with an overlay of additional engineering. The standard required for site distance is 335 feet and at this station there was only about 290 feet of site distance. The original plan does not work out as an option. The bridge and the crest obstruct the view.  DOT came up with an approximate location where the site distance could be met. At best there would be a gain ¼ of an acre. Brian stated the new configuration would be safer than what is currently there. There would be one intersection versus three. An estimate for this construction is approximately $40,000.

   * Library Trustees Lynn Stevens and Sam Harding attended the meeting to discuss the library budget. Lynn reported a fire safety door in the back of the library for egress is required to meet code. The propane tank would have to be moved also. Lynn mentioned the library incurred some expenses this year. Sam Harding stated the lighting in the building had to be changed. Sam Harding reported on library income and expenses. An estimated cost for this project is $5,500-$6,000.  Gary Allen stated there is a concern because children use this building. Richard Bennett stated a second form of egress is advisable because hopefully this building will always be used for something in town. Lynn agreed it is an important building. The selectmen agreed the library is a town building and should be brought up to code. They agreed to put this expense in the Maintenance of Town Property Building budget. Lynn will submit a proposal for this project. Tracy Mosston requested the town’s appropriation for the library and the cost of the fire safety door before the first budget hearing.

   * The selectmen signed an appointment form for Gordon Lang as Forest Fire Warden.

   *  Intent to cut for United States Forest Service Popple Mountain was signed by the selectmen.

   * The selectmen reviewed a memo from Jason Carr, Building Inspector, regarding a building permit that they requested he investigate on Carter Notch Road. Through his investigation it was his opinion that the project went beyond the scope of the building permit application. The selectmen discussed the appropriate action that the town should take.  The selectmen decided to put a Cease and Desist on this project and send a letter to the owner of the property and request he attend a selectmen’s meeting to discuss this situation. The selectmen will request that Jason occasionally verify that no further work is being done on this project. The selectmen will request that Jason contact Shana Myers for an interior inspection of her home as agreed by her at a previous selectmen’s meeting.

   * The selectmen received a health code complaint regarding a local establishment. As the health officers for the Town of Jackson, the selectmen will send a letter addressing this complaint.

   * The selectmen signed abatement of taxes for Conway Felton.

   * The selectmen agreed to the request of Tracy Mosston to close the office to work on the town report 12:30 p.m.-4:30 p.m. on the following dates: Thursday, January 26, February 2, 9, and 16, 2006.

   * The selectmen agreed the budget hearings for the 2006 budget will be held at the town office on January 30, and February 6, 2006 at 6.p.m.

   * The selectmen reviewed the memo from the Coalition Committee that the House passed the technical correction, the amendment to HB100, which would allow Donor towns to use/adjust current spending so the Statewide Property Tax amount can stay within our communities. The legislation now moves to the Senate. This would eliminate Jackson as a donor town.  

    * The selectmen received a letter from Conway stating that they are sending a formal request to Time Warner/Adelphia to discontinue broadcast of the Channel 3 PEG signal to the towns of Bartlett and Jackson because it is their opinion that the provision of this channel violates the terms of their franchise agreement. The selectmen will bring this issue to town meeting to ask the town whether they would like to keep the franchise fees from Adelphia to reduce taxes or return these funds to Adelphia for Channel 3.

   * New Hampshire Department of Environmental Services sent a letter to the town to advise them that all issues at Christmas Farm Inn maintenance shed on Valley Cross Road has been resolved.

   * The meeting started at 5:30 p.m. and ended at 8:10 p.m.
