MINUTES – December 16, 2004– UNOFFICIAL UNTIL APPROVED
Members Present: Betsey Harding, David Urey, Brooks Dodge, Scott Badger, John Fichera, Steven Weeder, Dick Bennett. Absent with notice, Ira Lynn and Willis Kelley. Town counsel Rob Upton also attended, to advise the Board on proposed changes to the Zoning Ordinance.
Chair, Betsey Harding called the regular meeting of the Jackson Planning board to order at 7:00 pm.
This meeting will focus on the proposed changes to the zoning ordinance; with no secretary to record the discussion, these minutes will refer to the revisions which will be posted on or before December 21st.
Rob Upton made recommendations on wording changes for Section 1, B, Purpose. Board members agreed that those changes will be included in the proposed changes.
Board members explained to Rob Upton the decision made at the last meeting, to not change #1-4 in SECTION 2 B. Rob reviewed additional wording submitted and explained that those additional proposed changes would not achieve our objectives. He believes that the wording of Section 2 suffices for our current needs.
SECTION 3: DEFINITIONS
Discussion of the “definition” section focused on the following:
* Height, Building or Structure – Members concurred that the proposed change “neither be more than thirty-five (35) feet from the natural ground surface at any point nor more than thirty-five (35) feet from the finished “as built” grade at any point” clarifies the way this regulation should be interpreted. We will need illustrations; Stephen Weeder will work on them. The last sentence of that definition should begin with “Chimneys and….”
* Recreational Trail – Members agreed to bring this forward as a permitted use in all districts.
SECTION 4: DISTRICTS & DISTRICT REGULATIONS
Section 4.A Town-Wide Regulations
1. A housekeeping change will move “prior written approval…” closer to the beginning.
6. SETBACKS: Rob Upton stated his hope that this section would remain within each applicable district, for an applicant’s ease. Members decided to add the words “porch, or deck” to the first line, after “structure,” and at “d.,” to drop the words “which is a property boundary” because a 50 foot setback is reasonable from any stream or body of water. These changes will be made in all districts.
7. TEMPORARY USES AND STRUCTURES – Board members agreed to this addition:
A permit for a period not exceeding one year is required prior to placement of a temporary structure (such as a construction trailer on a job site). Such permits are conditioned upon agreement of the owner to remove the structure or use upon expiration of the permit. Such permits may be renewed upon application for an additional period of one year as long as construction is active.
SECTION 4.B. Division of Town into Districts – Board members decided to focus more attention on this section next year, but not to propose changes now..
SECTION 15. ZBA – Board members decided to propose wording recommended by Rob Upton to comply with current case law.
SECTION 16. EFFECTIVE DATE, CONFLICT AND SEVERABILITY
Board members decided to propose the new wording for this section.
OTHER BUSINESS:
The next regularly scheduled meeting (Thurs. Jan 13, 2005, 7:00pm) will also be the required Public Hearing on Proposed Zoning Ordinance Amendments; in addition, applications for a subdivision, a lot line adjustment, and one or more voluntary mergers will need to be heard.
A motion was made, seconded, and passed to adjourn the meeting. The Chair adjourned the meeting at 9:30 pm.
