Planning Board Minutes Work Session - 11/20/03

Members present: Richard Bennett, Brooks Dodge, Betsey Harding, Sarah Kimball, Ira Lynn and Stephen Weeder. Alternate member John Fichera was present. Bill Kelley and Bob Dupuis had reported that they would be unable to attend this work session.

Others attending:  Mary Burack, Gleb Grigorovich-Barsky, Rosemary Grigorovich-Barsky, David Matesky, Helene Matesky, Henry Harmon, Walter Yachesyn, Richard Devellian, Dave Mason, Bob Kantack, Stan Bodkins, Lisa MacAllister and Suzanne Scolamiero.

Chairman Betsey Harding called the work session of the Planning Board to order at 7:00 p.m.  She explained that this was a work session for the planning board members and at this point no further comments or discussion would be asked for from the public. She reported that she had received several notes, e-mails and other input since last week’s meeting; no information had been submitted supporting aircraft landing and takeoff opportunities; two respondents had suggested regulating by hours; and about 60 commented strongly in favor of full restrictions against aircraft landings and takeoffs in Jackson.  Some people had done research to be brought to our attention.  Several people commented on the importance of honoring wording such as “preserving the rural village character” in the policy statements of our August 2003 Master Plan.  Strong sentiment favors taking strong action on this issue.

Chairman Harding passed out two drafts of the proposed ordinance: one with a negative or “not permitted” tone, and one with a positive or “permitted except” approach; at a prior meeting, Attorney Rob Upton had recommended using one approach or the other in future ordinance wording, and suggested that the “not permitted” version by used here. It was decided to title the more positive proposal as Option 1 and the negative proposal as Option 2 for clarity.
Brooks Dodge reported that most input of the he has received is opposed to permitting any further aircraft landings. He favors the negative approach.  He noted that the towns surrounding Jackson prohibit landings altogether and we should follow suit.  Stephen Weeder wanted to know if the public hearing we had last week constitutes the required first public hearing. He was answered in the affirmative.

Betsey Harding read from ordinances she had received from other towns on the wording of their ordinances on this subject. After hearing the options, the members liked the brevity and simplicity of the Bartlett ordinance.  It was agreed to accept Option 2, but with certain changes to tailor it to Jackson’s needs. This proposed zoning ordinance, along with housekeeping ordinance Section 3 will be presented at another public hearing, during the December 11 regular meeting.

Members decided to conduct no further business.  Chairman Betsey Harding adjourned the work session at 8:30 pm
